SELECT is a software provided by Copeland Europe GmbH (“Copeland”) to assist with the selection of compressors, condensing units and Alco Controls (i.e., precision mechanical controls for the refrigeration and air conditioning markets) in relation to their location, selected application and accessibility class in regard to the applicable standards – hereinafter, the “Tool”.

The Tool and all information contained and/or generated are provided “as is”. Copeland does not represent or warrant that the software, all information contained and/or generated, or materials in the Tool are accurate, complete, reliable, or that the Tool is free of viruses or any other harmful components. Running cost information is provided for comparison purposes only and Copeland cannot be held liable for any measured running cost, which is found to differ from predictions.

Copeland shall not be responsible for issues arising from application of compressors, units and Alco Controls using information provided by the Tool. It remains the user’s responsibility to validate the information contained and/or generated by the Tool and to determine the fitness of Copeland products for inclusion in user’s original equipment and/or compatibility with the end-use application. Copeland assumes no responsibility and or any subsequent liability for any claims or damages howsoever arising, in particular if appropriate risk management were not implemented adequately by the user.

Copeland shall not be responsible for how any risk assessment is performed and utilized and shall not be responsible for its content or findings. Nothing within any such assessment shall override any requirements needed to comply with the statutory obligations, as well as all associated regulations and common codes of practice.

Copeland its members and their respective affiliates, agents and/or suppliers, officers, directors and employees expressly disclaim any and all warranties, whether express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of the rights of third parties. As far as permitted under the laws of the relevant jurisdiction, Copeland disclaims all responsibility for, but not limited to, any loss, injury, claim, liability or damage of any kind resulting from, arising out of, or any way related to:

• any errors in or omissions from the Tool and its Information, including but not limited to technical inaccuracies and typographical errors,
• any third-party websites or third party applications, software and content, directly or indirectly, accessed through hypertext links made available in connection with the Tool, including but not limited to any errors in or omissions there from,
• the unavailability of the Tool, Information, or any portion thereof,
• usage of the Tool,
• problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, internet access providers, computer equipment, software, or any combination thereof, including without limitation any injury or damage to your or any other person’s computer as a result of using the Tool, or
• usage of any equipment or software in connection with the Tool.
